THERE ARE TWO PATENT MODELS
PATENT REGISTRATION
An innovative and original creation of a product or process that brings benefits to society and that meets the requirement of inventive step, novelty and industrial application.
The invention patent has 20 years of protection from its deposit, at which time the product will fall into the public domain, that is, anyone can exploit it.
UTILITY MODEL
An existing object, which presents a new shape or modification, which results in a functional improvement in its use or manufacture.
This type of patent has a shorter validity, that is, 15 years of protection from its grant.
To better exemplify, we can think of a pencil and an eraser.
Two separate products with their distinct features. However, from the moment these functionalities are combined in the same object, we create the eraser pencil. In this example, we have a Utility Model Patent.
INDUSTRIAL DRAW
We understand this third type as a pseudo-patent, since the formal document is the registration certificate and not the letter patent.
It is the changes in the plastic form of an object that results in a new and original product, which can be used in industrial manufacturing.
Valid registration will be 10 years, renewable for three successive periods of 5 years.
